I have been working at my job since Feb of 2008 as a 1099 contractor. I work in an office Monday through Friday, and use all of my bosses equipment and have my own office, etc. Is it legal for him to keep me as a contractor? I have heard that when you work the hours they set for you, use their equipment, do the job the way they want it done, etc then that makes you an employee... Ipswich: I would like to cash out of my 401K?
I have 2 401K plans - one with a previous job I had for 2yrs - about $5900 and one with a company I worked for 5yrs ago for about 6yrs - 21K. I need MONEY and would like to cash out the $5900 - with penalities - i can receive about $3400 - which i can use RIGHT NOW? Is this a good idea - my current job does not have 401K until a full year of employment - i am on my 5mth...once I complete my full year I can transfer the 21K. Thanks...

There are no jobs I really want to work at. I don't want to be a doctor or a lawyer nor do I want to work retail or fast food nor would I be a teacher . I simply want an office job but yet I never get the job I really want and I always have to get a job that I don't like. Why does the universe work in everyone elses favor but mine ? I honestly hate manaul labor jobs and I hate jobs working with kids and I hate jobs being around people. So I would rather much have an office job but you can't even find a work at home job without paying some amount to join that you can't afford....
