I work for an agency of a company (I'm employed by the agency and not the parent company). There is a senior post open which I am going through the selection process for and am at the final interview stage. Things are looking good but I have been told that there is a person that works for the parent company that is desperately wanting the job. I live in the United States and am a manager for a company that employs about one hundred legal filipino workers. We have found that 75% of filipino workers are very unreliable. The will work for a couple days to get some money, then they won't show up for a few days until their money runs out. I have been working at my job since Feb of 2008 as a 1099 contractor. I work in an office Monday through Friday, and use all of my bosses equipment and have my own office, etc. Is it legal for him to keep me as a contractor? I have heard that when you work the hours they set for you, use their equipment, do the job the way they want it done, etc then that makes you an employee... I make phone calls and do marketing for the company, and I do not make much money, between $11,000 and $15,000 a year, but these are all 1099 wages and I am going to be hurting when tax time rolls around.. As my internship was coming to an end i asked him if he can provide me with some advice how i can make my resume stronger. So he helped me out which i appreciated.
